Online Orders

Placing an online order consitutes the creation of a contract between CuCuu and you. The technical steps required to create an order are as follows:

  • a) You place the order for your product(s) on the website by clicking the 'Buy Now' button on the Checkout page of the website
  • b) Payment will be taken via Paypal prior to dispatch of the goods
  • c) We will send you an order acknowledgement e-mail detailing the products you have ordered. This is not an order confirmation or order acceptance from us.
  • d) Our acceptance of your order will only take place upon dispatch of the product(s) ordered.

The contract between us shall be governed by and interpreted in accordance with Scottish law and the Scottish courts shall have jurisdiction to resolve any disputes between us. These terms, together with our current website prices, delivery details, contact details [and privacy policy], set out the whole of our agreement for the supply of the products to you by us.

Payment

With regard to any contract for the purchase of products from the CuCuu website all prices and delivery charges are the full prices. The total cost of your order is the price of the products ordered plus delivery charges as set out in the Delivery section of the website.

Once an order has been placed, the full price for your order is set. CuCuu reserve the right to change any prices at any other time.

Payment can be made by bank account, credit card, or PayPal balance. You confirm that the credit, debit or store card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, We will not be liable for any delay or non-delivery.

Basket Timeout

Each product on this website is unique so this posed a few questions for implementing the purchasing mechanism: do we remove the product from the shop when someone adds it to their basket or when they actually finish buying it? What happens if someone adds a product to their basket but does not buy it? We decided that a product should be removed from the shop when added to a basket so two users didn't have the same product in their baskets. To ensure that a product is replaced in the store if a user adds it to their basket but does not buy it we introduced a product timeout - each item added to your basket will automatically remove itself and return to the shop if it is not purchased within 45 mins of adding. Once a product has returned to the shop anyone can buy it. In the unlikely situation that two parties both purchase the same item, CuCuu will arbitrate and determine the rightful owner of the item.

Cancellation by us

We reserve the right to cancel the contract between us. In the event of non-availability of goods, we will contact you to arrange alternatives or a refund where applicable. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your account as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of products to you

We will deliver the products ordered by you to the address you give us for delivery at the time you make your order.

CuCuu cannot guarantee specific delivery dates and time but delivery will be made as soon as possible after your order is accepted.

You will become the owner of the products you have ordered when they have been delivered to you. Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Read about delivery including costs. CuCuu cannot be held responsible should local customs authorities wish to confiscate any particular item ordered, or charge any import duty on such items. The recipient is responsible for paying the duty.

CuCuu accepts no responsibility for items being lost or damaged in the post. Every effort is made to package the products in a suitable manner to reduce the risk of damage to a minimum.

All items are sent by recorded delivery to ensure a secure service. This service requires a signature upon delivery. If the recipient is not there to receive the package it will be taken back to the Royal Mail collection office where it will be kept for 7 days. In this instance a redelivery or collection will have to be arranged by the recipient. If the package is not collected within 7 days it will be returned to CuCuu. If this happens please contact CuCuu by email or telephone as soon as possible to arrange a redelivery. All postage costs will be charged to the customer. All additional postage costs will be invoiced by CuCuu using the secure online Paypal invoicing system. If the customer would prefer to cancel the order this can happen only after CuCuu has received the returned package and only the cost of the item(s) will be refunded. Postage costs will not be refunded.

Disclaimer and limitation of liability

We have made every effort to display the products featured on our website as accurately as possible. However, the colours we use, as well as the display and colour capabilities of your particular computer monitor, will greatly affect the colours you actually see on the screen. We cannot be held responsible for the limitations of technology and cannot guarantee that your monitor's display of any colour, texture, or detail of actual merchandise will be accurate.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on the website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.

If the products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email at info@cucuu.co.uk of the problem within [20] working days of the delivery of the products in question.

If you do not receive products ordered by you within [28] days of the date on which you ordered them, you must notify us within [40] days of the date on which you ordered the products. If you do not do so, we shall have no liability to you. If you notify a problem to us under this condition, our only obligation will be, at our option: to make good any shortage or non-delivery; to replace or repair any products that are damaged or defective; or to refund to you the amount paid by you for the products in question in whatever way we choose.

Unless it was reasonably foreseeable at the date that the agreement came into force, we will not be liable to you for any indirect or consequential loss, damage or expenses however they arise.

Nothing in these terms is intended to restrict any legal rights that you have or exclude or limit our liability to you for any death or personal injury resulting from our negligence

Events beyond our control

We shall have no liability to you for any failure to perform any obligation under this contract (express or implied) where such failure is caused by any event or circumstance beyond our reasonable control including, without limitation, breakdown of systems, flood, fire, explosion or accident.

Complaints

CuCuu would hope that you would not have any cause for complaint as we are committed to maintaining excellent standards of customer service. However should you wish to make a complaint, please email us at info@cucuu.co.uk.

Consumer Protection

These terms and conditions do not affect your statutory rights.

Returns Policy

CuCuu wish to offer the best quality stock and customer service. If, after receipt of your goods you find any faults or incorrect items, we will arrange either a refund or a replacement product. Customers must notify CuCuu of any returns within 14 days from the date you receive the ordered product and proof of purchase will be required.

Unused items in new condition may be returned to our contact address for a full refund at any time up to 14 days after receipt. The purchase price (excluding postage) for the returned items will be credited to your account within 10 working days.

We strongly recommend that you use registered post, recorded delivery or another secure method of delivery, retaining the receipt until you have received credit for your return. We regret that we cannot be held responsible for non-delivery of returned goods.

The goods must be returned unused, in their original undamaged packaging. We will consider the condition of the goods being returned when making a refund.

Intellectual Property

Each item, all photographs, logo and every other component of the website itself is protected by copyright and may not be reproduced by any persons. The Copyright, Designs and Patents Act 1988 states that copyright is automatic once an idea is put on paper or created in the form of a work of artistic craftmanship, a piece of graphic work, sculpture, photograph or collage.

You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Privacy

CuCuu is committed to maintaning your privacy. No registration or login is required to use this site and no personal information is taken through the CuCuu site during the buying process. Personal information required to make a purchase is taken and stored by Paypal on their secure servers (Paypal's privacy statement).

Your Personal Information will not be disclosed to any third party other than the Royal Mail who will deliver your order. You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal information we are entitled do so.

You may choose to add your email address to our mailing list. All email addresses are held on a private database and security precautions have been put in place to prevent alteration, loss or misuse of the data that is under our control. We will comply with the standards, procedures and requirements laid down in the UK Data Protection Acts 1984 and 1998 and any future legislation to ensure that your personal information is kept secure and processed fairly and lawfully.
